Section 1 — The Basics

What cookies are, and why we use them

A cookie is a small text file that valerive.com places on your computer, phone or tablet when you visit us. It lets our store remember things between page loads and visits — for example, that the Zirella Summer Dress is still in your basket, that you're browsing in GBP, or that you've already told us your cookie preferences so we don't ask twice.

We also use similar technologies such as pixels (tiny transparent images used by advertising and analytics partners) and locally stored values in your browser. Wherever this policy refers to "cookies", it covers these related technologies too.

We rely on cookies for three broad reasons: keeping the shop working correctly (checkout, your account, your bag of dresses), understanding — in aggregate — how people move through our collections and product pages so we can improve fit guides, sizing and page speed, and, only with your consent, showing you relevant marketing about new arrivals, restocks or items you viewed but didn't buy.

Valerive is a trading name operated by S Commerce. As the data controller, S Commerce decides why and how cookies are used on this site and is responsible under both UK data protection law and Dutch/EU data protection law for the choices explained on this page.

Because we are established in the Netherlands and sell to customers in the United Kingdom, this policy — and the cookie consent choices you make — are governed by both the EU General Data Protection Regulation as implemented in the Netherlands (the AVG) and the UK GDPR together with the Privacy and Electronic Communications Regulations 2003 (PECR).

Section 3 — Legal Basis & Consent

The law behind every cookie we set

Strictly necessary cookies (the ones that make checkout, your account and your bag work) are used on the basis of our legitimate interest in running the site you asked to use — Article 6(1)(f) UK/EU GDPR — and fall within the "strictly necessary" exemption under Regulation 6 PECR, so no banner consent is required for these.

Every other cookie — functional, analytics and marketing — is switched on only after you give consent that is freely given, specific, informed and unambiguous, as required by Article 7 UK/EU GDPR and Article 6(1)(a). This is delivered through the cookie banner described in Section 6.

In the United Kingdom, cookie consent is additionally governed by PECR (the Privacy and Electronic Communications Regulations 2003), most recently reformed by the Data (Use and Access) Act 2025. From 5 February 2026, PECR permits a narrow set of low-risk cookies — for example first-party statistics that never leave our own systems — without prior consent, provided we remain transparent and give you an easy opt-out. Because our analytics and advertising tools (Google Analytics, Meta Pixel) share data with third parties, we do not rely on this narrow exemption for them: we ask for your consent regardless.

In the Netherlands, the placing and reading of cookies is separately regulated by Article 11.7a of the Telecommunicatiewet (the Dutch implementation of the ePrivacy Directive), enforced by the Autoriteit Consument & Markt, alongside the AVG, enforced by the Autoriteit Persoonsgegevens (the Dutch Data Protection Authority).

Every cookie we set falls into one of these groups. You can accept or decline each of the last three independently — see Section 6.

Keep your shopping bag intact as you browse from the Zirella Summer Dress to a Fransesca Maxi Dress, hold your session securely through checkout, remember which currency and country you're shopping in, and store the cookie choices you've already made. These cannot be switched off, because the store would not function without them.

Remember smaller preferences that improve your visit — such as a previously viewed size guide, a wishlist of dresses, or that you've already seen a promotional banner — so we don't repeat ourselves unnecessarily.

Section 6 — How We Ask

Your consent, asked for properly

When you first visit valerive.com, a banner asks whether we may use functional, analytics and marketing cookies. You can Accept All, Reject All non-essential cookies, or open Customise to switch each category on or off individually before choosing Save Preferences.

Nothing beyond strictly necessary cookies is set until you make a choice. You can change your mind at any time using the "Cookie Preferences" link in the site footer, and we will re-ask if this policy changes materially.

Section 7 — Keeping a Record

How long we keep your consent choices

Under the accountability principle in Article 7(1) UK/EU GDPR, we must be able to demonstrate what you consented to and when. Your cookie preference is stored, together with a timestamp, for up to 12 months, or until you change it — whichever is sooner. After that period, or whenever this policy changes materially, we ask again.

Withdrawing consent is as easy as giving it: use the "Cookie Preferences" link in the footer of any page. Withdrawal does not affect the lawfulness of any use of cookies before you withdrew.

Section 8 — Beyond Our Banner

Controlling cookies through your browser

Every major browser lets you view, block or delete cookies directly. You can find instructions for Google Chrome, Mozilla Firefox, Safari and Microsoft Edge on their own support pages, along with equivalent settings in their mobile apps.

If you prefer to opt out of Google Analytics across all websites, Google offers a dedicated browser add-on. For advertising cookies generally, you can review your choices through Your Online Choices (Europe) or manage your Meta advertising preferences directly in your Facebook ad settings.

Please note that blocking strictly necessary cookies through your browser may prevent parts of valerive.com — including your shopping bag and checkout — from working correctly.

Section 9 — Your Rights

Your data protection rights, in the UK and the Netherlands

Wherever a cookie involves personal data, you have the following rights under UK GDPR and EU/Dutch GDPR (AVG): to access the data we hold, to have inaccurate data corrected, to request erasure, to restrict or object to processing, to data portability, and to withdraw consent at any time without affecting past lawful processing.

Section 10 — Where Data Travels

International transfers of cookie data

Some of our cookie providers — Google (Analytics) and Meta (Pixel) — are based in, or transfer data to, the United States. Where this happens, the transfer is protected by recognised safeguards such as the UK International Data Transfer Agreement, the EU Standard Contractual Clauses, and, where applicable, the UK's data-bridge extension to the EU–US Data Privacy Framework. These safeguards are designed to ensure your data continues to receive a level of protection equivalent to that guaranteed under UK and EU/Dutch law.

Section 11 — Children

Not directed at children

Valerive sells women's clothing and dresses and is intended for adult shoppers. We do not knowingly set marketing cookies for, or collect personal data from, children, and we do not knowingly market to anyone under the age of 18.

Changes to this policy

We may update this Cookie Policy as our tools change or as UK and Dutch/EU law evolves — including future ICO guidance under the Data (Use and Access) Act 2025. The version in force is always the one published here, dated at the top of this page. Where a change is material, we will ask for your consent again.
